Former Richneck Elementary Assistant Principal Appeals $10 Million Verdict in School Shooting Lawsuit

A high-profile legal dispute stemming from a catastrophic elementary school shooting in Newport News, Virginia, has moved into a new phase as the former administrator found liable for the incident formally challenges the civil court judgment against her. Dr. Ebony Parker, who previously served as the assistant principal at Richneck Elementary School, is seeking to overturn a jury verdict that awarded millions of dollars in damages to an educator wounded in the classroom.

The legal action follows the January 6, 2023, shooting of first-grade teacher Abby Zwerner, who was severely injured when one of her six-year-old students discharged a firearm inside the school. The shocking event drew nationwide attention, sparking intense scrutiny over how administrators handled reports regarding the child's possession of a weapon before the gunfire took place.

Following a civil trial concluded the previous November, a jury determined that Parker's inaction and conduct constituted negligence that directly facilitated the shooting. Jurors ruled in favor of Zwerner, ordering Parker to pay $10 million in damages to compensate the teacher for the catastrophic physical and emotional harm she suffered during the incident.

Parker has now taken the case to the Court of Appeals of Virginia, asking the appellate judges to toss out the jury's findings and vacate the monetary award. Her legal team argues that the trial court's decision was flawed and should not stand, aiming to nullify the outcome reached by the civil jury.

Central to Parker’s appeal is the contention that the teacher's injuries should fall exclusively under the statutory jurisdiction of the Virginia Workers' Compensation Act. Under this legal argument, workplace injuries covered by workers' compensation statutes would typically be barred from being pursued through independent civil personal injury lawsuits against colleagues or administrators.

Attorneys representing Zwerner have mounted a vigorous defense of the original verdict, filing a formal answering brief that urges the appellate court to reject Parker’s petition. Zwerner's counsel contends that the jury’s decision was legally sound and firmly justified by the evidence presented during the extensive civil proceedings.

In a statement addressing the appeal, appellate attorney Matthew Guarnieri of the firm Gupta Wessler LLP underscored the ongoing physical toll the shooting has exacted on Zwerner. Guarnieri noted that the first-grade instructor sustained life-threatening trauma and continues to live with a substantial bullet fragment lodged adjacent to her aorta.

Guarnieri further outlined the evidentiary basis for the jury's finding of gross negligence, noting that Parker had dismissed warnings that the student was armed. According to the attorney, Parker ridiculed the possibility that a young child could conceal a firearm inside his clothing, specifically mocking the notion regarding his small pockets, and directed staff members to delay searching the student.

Expressing steadfast confidence in their legal position, Zwerner's appellate team stated that Parker is improperly attempting to disregard the compelling trial record. Guarnieri asserted that the legal team remains fully confident that the Court of Appeals of Virginia will review the trial findings and affirm the multi-million dollar judgment.

Attorney Diane Toscano, who has represented Zwerner throughout the proceedings, also released an additional statement maintaining that an appellate filing cannot erase the documented choices made by the former administrator. Toscano argued that Parker disregarded repeated, direct alerts regarding the presence of a weapon on school grounds on the day of the attack.

Reflecting on the jury's conclusion, Toscano noted that the panel had listened carefully to the evidence before holding the former assistant principal accountable. She stressed that the brief submitted on behalf of the injured educator clearly establishes that the verdict aligns with Virginia state law and should remain undisturbed.

Attorney Jeffrey Breit, another key member of Zwerner’s legal team, similarly voiced optimism regarding the upcoming appellate review. In comments provided to local station 10 On Your Side, Breit expressed strong confidence that the higher court will uphold the jury's determination and preserve the judgment against Parker.

During the civil trial, Parker's defense maintained that she should not be held legally responsible for the violent actions of the child. In closing statements, defense attorney Sandra Douglas implored jurors not to assign blame to the former assistant principal or compound what she described as an already devastating tragedy.

Despite the arguments presented by the defense at trial, the jury ultimately sided with Zwerner, concluding that administrative inaction played a decisive role in allowing the shooting to occur. The pending appeal ensures that the questions surrounding administrative responsibility will now undergo formal scrutiny by state appellate judges.

News outlet 10 On Your Side reached out to Parker’s defense counsel to request updated comment regarding the appeal and the arguments raised in the latest legal briefs. As of the time of reporting, the defense team has not issued a new statement detailing their position.

More than three and a half years after the Richneck Elementary shooting sent shockwaves across the country, the ongoing appellate proceedings highlight the enduring legal and personal aftermath of the tragedy as both sides await a binding decision from Virginia's appellate court.
