A 60-year-old Oakland County resident has been ordered to stand trial after being accused of unlawfully registering her non-citizen spouse to vote ahead of the 2024 presidential election. The legal proceedings mark the latest development in a high-profile state investigation into election irregularities and unauthorized voter enrollments.

The defendant, identified by state authorities as Kimberley DiDonato of Rose Township, had her case formally bound over to the Oakland County Circuit Court. The transfer from district court follows a preliminary determination that sufficient evidence exists to proceed with a criminal trial on multiple felony counts brought forward by state prosecutors.

DiDonato faces significant potential prison time under Michigan law. Prosecutors from the Michigan Attorney General’s Office have charged her with one count of election forgery, a felony offense carrying a maximum statutory penalty of five years in prison, as well as one count of using a computer to commit a crime, a separate felony that carries up to a seven-year prison term.

According to court filings and scheduling notices, DiDonato is formally slated to appear before an Oakland County Circuit Court judge for her arraignment on September 22. The upcoming court appearance will establish the initial schedule for pretrial motions, evidentiary hearings, and the setting of a definitive trial date.

Investigators allege that the illicit activity began in April 2024, when DiDonato accessed Michigan’s online voter registration portal. State officials maintain that she intentionally impersonated her husband during the digital application process, submitting his personal identifying information without legal authorization and falsely certifying that he held United States citizenship.

While DiDonato is a natural-born or naturalized United States citizen, her husband holds legal status strictly as a lawful permanent resident. Under both Michigan statutory regulations and federal voting laws, lawful permanent residents and other non-citizens are strictly prohibited from participating or registering in any municipal, state, or national elections.

The sequence of events progressed further in May 2024 after election administrators processed the digital application and issued an official voter registration card to the couple's Rose Township address. Authorities reported that after receiving the document in the mail, DiDonato personally contacted her local township clerk to request that the newly created registration be formally voided and cancelled.

When questioned about the unauthorized submission, DiDonato claimed to investigators that she had orchestrated the registration as an independent audit of election infrastructure. Prosecutors noted that she asserted she was attempting to test Michigan's voter registration database for security vulnerabilities and verify whether the automated systems could identify and filter out ineligible registrants.

State law enforcement officials rejected that justification, emphasizing that self-styled security evaluations that break statutory laws cannot be excused. Michigan Attorney General Dana Nessel underscored that preserving the democratic process requires uncompromising enforcement against deliberate statutory violations regardless of the underlying motivations claimed by offenders.

"Trust in our election system requires holding people accountable in the rare instance that they violate our statutes," Attorney General Nessel stated following the court's bind-over ruling. She added that her office remains dedicated to carrying out its legal mandate to aggressively investigate suspected criminal violations of Michigan Election Law and bring offenders before the judiciary.

The prosecution against DiDonato forms part of a broader, statewide push by the Attorney General's Office to address unauthorized voting activities. Last month, Nessel publicly revealed charges against DiDonato in tandem with legal actions brought against five non-U.S. citizens who allegedly cast illegal ballots during the 2024 election cycle.

DiDonato’s legal counsel, defense attorney Kevin Kijewski, could not be immediately reached for comment regarding the district court’s bind-over decision or the defense strategy planned for the upcoming circuit court proceedings.

The case against DiDonato emerges amid a string of other notable election-related prosecutions across the state of Michigan. These legal actions illustrate an ongoing, systematic effort by state and local prosecutors to penalize fraudulent ballot handling, application deception, and petition manipulation.

In a recent matter concluded just last month, a Hamtramck city councilman received a criminal sentence consisting of probation and mandated community service. That penalty followed his misdemeanor conviction for submitting a false statement on an official absentee ballot application.

Earlier this year in March, state prosecutors also secured a substantial prison sentence in a major election fraud conspiracy stemming from the August 2022 primary. In that case, a key ringleader involved in a widespread petition signature fraud scheme—which effectively disqualified multiple gubernatorial and judicial candidates from the ballot—was sentenced to serve between four and twenty years in state prison.

As DiDonato prepares for her September 22 circuit court arraignment, state officials continue to emphasize that unauthorized tampering with official registration rolls carries severe legal consequences. The forthcoming proceedings in Oakland County will ultimately determine whether DiDonato's digital registration submission constitutes an intentional, prosecutable election felony under Michigan law.
