Florida Judge Denies High-Profile Bids by State Prosecutors and Jared Bridegan's Widow to Remove Her From Murder Case

A Florida circuit judge has firmly rejected separate motions submitted by state prosecutors and the widow of murder victim Jared Bridegan seeking to disqualify her from presiding over the impending trial of Shanna Gardner. The dual requests sought the immediate removal of Judge London Kite from the high-stakes criminal proceedings, arguing that her recent actions and procedural rulings demonstrated an impermissible level of bias.

The move to oust the sitting judge represents a rare turn of events in criminal jurisprudence, as petitions for judicial recusal are predominantly brought by defense attorneys rather than the prosecution. In this instance, however, both the State Attorney's Office and Kirsten Bridegan, the widow of the slain 33-year-old father, took the extraordinary step of challenging Judge Kite’s impartiality in the Duval County courtroom.

Judge Kite acted swiftly to quash both disqualification attempts, ensuring that she remains at the helm of the murder trial. The legal dispute arose following a flurry of eleventh-hour defense motions that were submitted just as jury selection was slated to commence on August 31 in Gardner's murder-for-hire trial.

Gardner stands accused of orchestrating the fatal ambush of her ex-husband, Jared Bridegan, in 2022. The targeted shooting occurred in Jacksonville Beach shortly after Bridegan had dropped off the former couple's shared-custody children at the residence Gardner shared with her new husband, Mario Fernandez Saldana.

The push to remove the judge from the case culminated on September 9 with a comprehensive 33-page motion filed on behalf of Kirsten Bridegan. The detailed filing contended that Judge Kite had visibly prejudged the widow's conduct and had demonstrated ongoing prejudice, creating an objectively reasonable fear that she could not receive fair treatment from the bench.

A primary pillar of the widow's disqualification petition centered on an abrupt judicial directive mandating that she surrender her personal cellular phone. Judge Kite had given Kirsten Bridegan less than 24 hours to hand over the private device to a digital forensics firm employed by the defense team, a measure the filing characterized as an extraordinary and unreasonably truncated mandate.

According to the motion, the judge issued the phone turnover order despite knowing that Kirsten Bridegan had submitted an emergency petition to the Fifth District Court of Appeal seeking an immediate stay. The widow's legal team argued that the hyper-accelerated timeline appeared deliberately designed to preempt and evade appellate scrutiny before the higher court could rule on the stay request.

The grievance was further exacerbated by what the filing described as a denial of due process and basic privacy protections. The motion asserted that Judge Kite ordered the cell phone's surrender after reviewing an ex parte submission from the defense team, without affording the widow an adequate opportunity to present formal objections regarding her constitutional privacy and victim rights.

During those exchanges, the judge was accused in the motion of reprimanding the victim's widow and alleging that she was improperly "thwarting" the pretrial discovery process. The motion argued that these actions, combined with the one-sided defense consultations, signaled that the court had already abandoned an open-minded posture toward the widow.

Tensions escalated dramatically when Judge Kite initiated indirect criminal contempt proceedings against Kirsten Bridegan. The show-cause order was triggered roughly 30 minutes after the deadline to surrender the device lapsed, occurring abruptly in the middle of ongoing trial proceedings for co-defendant Fernandez Saldana.

The circumstances inside the Duval County Courthouse during that moment were highlighted in the filing as clear evidence of prejudgment. The motion pointed out that sheriff's deputies were stationed both inside and outside the courtroom, positioned to take Kirsten Bridegan into immediate custody before any formal evidentiary hearing had taken place or any finding of guilt on contempt had been established.

Fernandez Saldana, Gardner's husband, has been facing his own trial on charges of first-degree murder and solicitation to commit a capital felony in connection with the 2022 Jacksonville Beach ambush. Jury selection in his case had begun on August 10, with State Attorney Melissa Nelson actively leading the prosecution's courtroom efforts.

Throughout the filing, the widow emphasized that any reasonable observer subject to such abrupt timelines, unilateral proceedings, and threatened detention would conclude that the court lacked fairness and neutrality. The motion concluded that Judge Kite's cumulative conduct established a clear basis for disqualification under state legal standards.

Despite the sweeping allegations presented by both the victim's family and the State Attorney's Office, Judge Kite’s swift denial of the disqualification motions leaves her in complete control of the ongoing proceedings. The ruling ensures that the high-profile prosecution of Gardner will continue to move forward under Judge Kite's oversight in Jacksonville.
