An Eva, Alabama, woman has avoided active incarceration after entering a guilty plea to chemical endangerment of a child involving her two minor children. The resolution of her case comes as her cohabiting romantic partner prepares to stand trial on related drug charges as well as felony child sexual abuse allegations involving her nine-year-old daughter.

According to Morgan County Circuit Court documents, 34-year-old Evelyn Dianne Fite reached a negotiated settlement with prosecutors that concluded with a sentencing order entered on August 27 by Morgan County Circuit Judge Charles Elliott. The court handed down a two-year prison sentence but fully suspended the term of imprisonment, ordering Fite to serve two years under supervised probation instead.

The legal action against Fite originated from an August 2025 grand jury indictment charging her with two counts of chemical endangerment of a child. Under the terms of the plea agreement approved by the court, prosecutors agreed to dismiss one of the two counts in exchange for her admission of guilt on the remaining charge.

The resolution of Fite’s case highlights an extensive investigation that first began in the late summer of 2024, uncovering hazardous domestic conditions and substance use in the household she shared with her boyfriend, 33-year-old Daniel Lee Doty. Court filings indicate that the pair resided together at a home located on Six Mile Creek Road in the rural community of Eva.

Law enforcement records show that the inquiry gained momentum in August 2024 following a specialized forensic interview with Fite’s 12-year-old son at the Cullman County Child Advocacy Center. During that evaluation, the preteen disclosed that his primary residence was with his father and stepmother, while his visitation schedule with Fite was limited to Wednesdays and the first and third weekends of every month.

Investigative affidavits prepared by the Morgan County Sheriff’s Office reveal that the boy detailed direct observations of illicit substance use during these visits. The child informed investigators that his mother frequently smoked marijuana and recounted an incident in which he discovered an uncontained needle at his aunt’s residence, reporting the finding to Fite, who allegedly took no corrective action.

Additional context in the court records documented significant family distress, noting that the aunt whose residence harbored the needle had previously lost legal custody of all but one of her own children.

A companion affidavit focused on the disclosures made by the boy’s nine-year-old sister. The young girl provided severe accounts to child protection investigators, alleging that Fite had intentionally blown marijuana smoke directly into her face. The girl also reported that both Fite and Doty regularly used marijuana in close proximity to her, exposing her to continuous secondhand drug smoke.

As the joint inquiry between sheriff's investigators and the Department of Human Resources deepened, authorities brought Doty into the Morgan County Sheriff’s Office for formal questioning on September 10, 2024. During this interview, Doty confirmed that he had been in a dating relationship with Fite and that the two had shared a household for approximately three and a half years.

The interrogation briefly paused when Doty initially invoked his right to legal counsel prior to being formally read his Miranda warnings. He was returned to the department lobby, but approximately 30 minutes later, he voluntarily changed his mind and agreed to proceed with questioning in the absence of an attorney.

During the interview, investigators addressed grave allegations that had emerged during the forensic child evaluations, specifically an allegation that Doty had sexually abused the nine-year-old girl. Doty acknowledged knowing that the child had made an accusation, stating that Fite had recently conferred with the girl's biological father, but he claimed to have received no specific details about the nature of the accusations.

Investigative personnel then confronted Doty regarding the children’s extensive, age-inappropriate familiarity with narcotics. When law enforcement officers remarked that the children possessed far too much specific knowledge about marijuana to have avoided direct exposure, Doty responded by conceding, "I bet they do."

Doty elaborated that the children had been raised in an environment surrounded by marijuana for virtually their entire lives, including an extended period when he, Fite, and the youth resided with Fite’s parents. While Doty acknowledged his own daily marijuana consumption and admitted that Fite also used the drug, he maintained that the children likely acquired their detailed knowledge simply from observing marijuana stored in a smoking bowl.

Despite admitting to heavy personal usage, Doty vehemently denied ever smoking directly in front of the children. He similarly disputed the allegations that he had ever blown smoke into the children’s faces, adding that he had never witnessed Fite engage in such behavior.

Following the investigation, a grand jury indicted Doty in August 2025 on two counts of chemical endangerment of a child, along with a separate indictment charging him with sexual abuse of a child under the age of 12. Both cases have been consolidated on the judicial docket and are scheduled to proceed to a jury trial on September 21.

In anticipation of the trial proceedings, Circuit Judge Jennifer Howell issued a formal protective order strictly barring Doty from initiating or maintaining any direct or indirect contact with the victims. Court records indicate Doty was originally taken into custody shortly after his September 2024 interview and was subsequently released in September 2025 upon securing a $20,000 appearance bond.
